Welcome to Skunky Brew. These Terms & Conditions ("Terms") govern your use of skunkybrew.com (the "Site") and your participation in the Skunky Brew founders list. By using the Site or joining the list, you agree to these Terms. If you do not agree, please do not use the Site.
Skunky Brew is a small-batch canned tea brand from the Dam Rodents universe, operated by Skunky Brew LLC ("Skunky Brew," "we," "us," or "our"). As of the date above, the product has not yet launched. Product names, flavors, descriptions, imagery, ingredients, packaging, pricing, and timing are in development and may change.
Joining the founders list is free and commits you to nothing. By joining, you agree to receive emails from us about the launch, the flavor vote, and founder pricing. You can unsubscribe at any time.
Founder pricing. We intend to offer founders the ability to purchase a 4-pack at $24, with that founder rate honored on future batches as described on the Site. Please understand:
The flavor vote. The founder flavor vote is advisory. We will weigh it seriously, but the final decision on which flavor launches first, and on all product matters, rests with Skunky Brew.
The fictional, cartoon "Skunky Brew" that appears in the Dam Rodents universe is a work of fiction. The real Skunky Brew beverage contains no alcohol (0% ABV). Any references to alcohol content tied to the cartoon are part of that fictional universe and do not describe the actual product.
Statements on the Site about ingredients or effects (for example, references to focus, energy, or mood) are for general descriptive purposes, have not been evaluated by the U.S. Food and Drug Administration, and are not intended to diagnose, treat, cure, or prevent any disease. Consult a healthcare professional with questions about your diet or health.
When the product becomes available for purchase, additional sale terms may apply at checkout. Prices are subject to change, except for founder pricing honored as described above. The first batch is expected to ship within the United States only; we may expand later. Estimated dates are goals, not guarantees, and may shift.
You agree not to misuse the Site, including by attempting to disrupt it, access it without authorization, scrape it at scale, or use it for any unlawful purpose.
The Skunky Brew name, logos, the Skunky character, can artwork, copy, and all Site content, along with the related Dam Rodents marks and materials, are owned by Skunky Brew and/or its affiliates and are protected by intellectual property laws. You may not copy, reproduce, or use them without our prior written permission.
The Site links to third-party sites and services (for example, Dam Rodents, and our social media accounts). We are not responsible for the content or practices of those third parties, which are governed by their own terms and policies.
The Site is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, Skunky Brew and its owners, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Site or the founders program. Where liability cannot be excluded, it is limited to the maximum extent permitted by law.
You agree to indemnify and hold harmless Skunky Brew from any claims, losses, or expenses arising out of your misuse of the Site or violation of these Terms.
These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules. Any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in Georgia.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Site after changes take effect means you accept the revised Terms.
